III. EMPLOYEE RETIREMENT INCOME SECURITY ACT (ERISA)
The Employee Retirement Income Security Act (ERISA) is a federal law that places standards that are minimum to be met for "most voluntarily established pensions and health plans in private industry to provide protection for individuals in these plans." (U.S. Department of Labor, 2008) the requirements of ERISA include the provision of plan information and fiduciary responsibilities to participants and makes a requirement of establishment of "a grievance and appeals process for participants to get benefits from their plans; and gives participants the right to sue for benefits and breaches of fiduciary duty."
