9). To help such victims, the Florida Department of Health had set up several billboards in Tampa and the billboards say, "Sex without consent is rape." Such billboards are hoped to helped the victims to come forward and identify the offender so that more women can be saved from similar abuse.
This increase in the number of crimes as well as the lasting effect it has on the victim qualifies it as a potential case for death penalty. This is not excessive when compared to the nature of the crime and the use of the eight amendment of the constitution to this crime should be removed. It was written in the constitution to protect people who are likely to be charged with death penalty for minor offenses and rape or sexual assault is by no means a minor offense. This is the reason it should be removed for this gruesome crime that is arbitrarily committed on innocent children.
Capital punishment for sexual crime is still opposed by many
However, the idea of capital punishment has gained more ground during the last few years. "Calls for law and order and the salient belief that child molesters cannot be rehabilitated have made the death penalty an attractive solution to a 'tough on crime' public in the United States. That these laws may conflict with the Court's holding in Coker is not generally a consideration for those seeking swift justice" (Rayburn, 2004. p. 1120). It is hoped that more and more people understand the emotional problems undergone by the victims and will move towards the idea of providing capital punishment to the offenders.
