Product Warranty For Home Improvements Term Paper

¶ … Product Warranty Products for home improvement are the most common commodities in the market from which consumers demand much warranty from the manufacturers because of the basic fact that they are expected to exist and last long within the presence of homes. Such products include both electrical and non-electric appliances, home furniture, as well as services and materials provided for home improvements. In general, product warranty, even in any type of transaction, equates product liability. In that the consumers expect that a product will only show the inability to provide its purpose because of wear due to length of period that it was frequently used or because of damage caused by the consumer's failure to take care of the product. Except from these two reasons, product reliability is expected. When product reliability is not served to consumers, product warranty comes in to protect the consumers' rights of acquiring quality products.

Product warranty makes the manufacturers, or any persons responsible for the delivery of a quality product, liable to any damage a product may have or to any damages a product may cause. Hence, product liability is covered in product warranty and in most consumers' law these two factors usually go hand in hand. In that a warranty guarantees the liability of concerned parties who are the sources of products should any product-related problem may be encountered by the consumer. European Journal of Marketing defines product liability, as a measure of product warranty, as follows.

Products liability is a general term that covers the rights of redress that are provided to persons or parties who suffer some form of damage or injury due to lack of contractual performance or lack of care on the part of those involved in the supplies, manufacture, distribution, and sale of product.

In a concern to the consumers' rights, the law recognizes warranty to guarantee honesty and fairness to both trading parties -- the consumers and the sellers. From the side of the provider of the products, such as the manufacturers, the following defines product warranty, as indicated by...

What's Inside the Product Warranty?

Many consumer product warranty laws cover different cases where consumers are guaranteed of their rights to quality products. Product warranty for home improvements is similarly covered by such laws. In fact, however, most of such laws are in general form thus covering a wide range of cases. But it is important to note that there are also limitations as to where the laws may apply. For instance, as indicated in the Consumer Products Warranty Law of New Brunswick,

The Consumer Product Warranty and Liability Act (CPWALA) applies to a wide range of cases. However, it does not apply in every case. It applies only to certain kinds of goods and to certain kinds of suppliers, and the extent of its coverage may vary depending on the category of buyer (or other affected person) and the kind of transaction involved.

Product warranty may apply to different kinds of transactions. Consumer Products Warranty Law of New Brunswick similarly lists the following as general transactions suggested to be covered by most Product Warranty laws.

sales leases barters or exchanges consumer products supplied under contracts for services consumer products supplied under contracts for labour and materials dangerously defective consumer products, whether supplied by contract or by any other means (e.g. gift or sample).
