(OSHA, 2005) In this particular case the employer General Dynamics did technically follow these guidelines as set forth by OSHA, even though the ultimate result was harmful to the employee's state of health. The employer in question did follow all of the legal specifics regarding the use of the toxic solvent, in terms of ventilating the tanks and only using skilled vs. unskilled personnel to enact the cleanup. The legal guidelines regarding cleaning the area and using Trinchloro were within OSHA standards. True, in its gaseous state, the solvent may cause serious illness or death.
