The types of management actions that align with employment laws and those that don't

The management actions that are aligning with employment laws would include: disclosing to the staff possible changes to the sales program in the next 90 to 180 days and informing everyone of the pending merger with Enviro Tech. However, there were several actions that were taken which could be considered to be questionable. Most notably, the fact that they indirectly made promises of: placing Garcia, Borden and Hsu in charge of marketing (once the merger is complete). This is problematic, because there is no indication from upper management that they are going to make such changes. At which point, the three could allege that there was some kind of verbal agreement between the management of Inter-Clean and Enviro Tech (in order for the merger to place). If they are laid off or are not given the promotion they could sue Inter-Clean for breach of contract. As Sally (the CEO of Enviro Tech) could claim that such an agreement was in place, which was a deciding factor in the merger. This could make integration of the two organizations more challenging, with everyone feeling that they were cheated (in one way or another). (Bays, 2009)

The most effective management practices in the workplace are communication and collaboration. This is where managers and executives would work with employees, to understand how they are being affected by what is taking place. At which point, they can begin addressing them, improving the atmosphere of the work environment. Once this takes place, managers can then from alliances with key employees, who can serve as a liaison and help to provide insights from the viewpoints of the staff. These different elements will ensure that the needs of all employees are being addressed, increasing the effectiveness of their strategy in a diverse workplace.
Clearly, the management of Inter-Clean needs to address the issues surrounding the merger with Enviro Tech and the new sales program. The most effective way to achieve this objective is: to improve communication and collaboration between management as well as the staff. This will help to address the morale issues facing the company, as it has begun to take on a life of its own. Therefore, it is imperative that management addresses these issues immediately. Otherwise, there is the possibility that the company could lose key employees and may face tremendous difficulties integrating the two organizations together.
