Part I: Interview Questionnaire
1. Can you briefly describe your current position, its duties, and responsibilities?
The role of Norma Dehlke as Director of Security and Human Resources has various functions. She is responsible for the security and safety of all employees, budgeting hours worked as regular shifts, over-time hours, and any concerns or complaints from the staff. Mrs. Dehlke creates the schedules, filling any open post, and delegating assignments for the supervisors to complete as needed. She conducts random drills for each shift as part of training. Such drills are code seven (serious injury), lockdown procedures for the emergency department, and other various emergency situations. Administering stat calls to ensure all personnel have been properly trained is essential to the day to day functions of security.
2. What is your hiring procedure like for personnel?
The hiring procedures for personnel consist of one submitting an application through the main branch. Human Resources will then contact potential candidates for an interview. Once the selection process has been completed, drug and alcohol screening is set up. Background screenings are submitted via fingerprinting, and new employee orientations are scheduled. Once all areas are covered and approved, the official hiring process begins. The manager will then schedule an interview and based on how one presents his or herself, she will then make the decision to hire the individual.
3. Is there any type of pre-employment screening?
The pre-employment screening is the extensive background check. An applicant must pass the drug screening to be able to obtain employment. All personnel have to go through a so many hours of probation before being able to join the union and permanent job placement. Drug screening is a zero tolerance policy (no second chances). Demonstrating one?s ability to lift, push, and pull at least 20 pounds is essential to the duties expected of the applicant.
4. What qualifications do you require of applicants?
The qualifications consist of one possessing a high school diploma or a certificate equivalent to one, such as GED. Manufacturing experience is preferred, however not necessary as training is provided. Supervisory positions require previous experience prior to employment with the company. Other positions may require computer skills. Such positions are within the clerical side of safety and security. Monitoring the cameras, alarms, and radio traffic from security officers calls for one to be able to work under pressure, multi-tasking is a necessity.
5. How extensive is the training period and process?
The training is extensive and an ongoing process. Every employee must go through basic safety training as well as training for safety and responsibilities of his or her work area. The first day consist of orientation, paperwork, registering vehicle information, employee badge and access cards, and, a tour of the facility.
6. What type of training manual do you use? What is included in this manual?
The type of training manuals used for personnel are found within post orders, training guides, New employee orientation (NEO) packets, safety tests, and compliance test completed yearly. The rainbow chart has each code listed along with proper ways of handling the situation.
7. What are some of the things included in your policy and procedures manual?
The policy and procedure manual withholds information pertaining to how one should respond to a safety call, security parking policy, and emergency procedures. Arriving to a safety call in a timely manner is important, however, responding and suiting up in the proper personal protective equipment is equally important. The parking policy is strictly enforced, in efforts to providing the patients with ample parking. An employee who fails to abide by the policy is subject to being towed at their own expense upon receiving three parking notices.
8. How often is this manual updated?
The policy manuals are updated as needed. Generally, each policy is updated yearly with the exception of on the need to basis. Parking policy has changed due to employees voicing concerns of not having ample parking. The policy was rewritten and more parking was made available to the employees however, the same rules applied.
9. What kind of supervision or management do personnel receive?
Supervisors are on each shift, accompanied by a lead officer in the presences or absence of leadership. During operational hours of the facility supervisor, Director of Security (DOS), House supervisor are present and readily available to assist should an incident occur. If a severe incident occurs management must be notified immediately.
10. What kind of ongoing training or professional development do personnel receive?
Amron provides ongoing training. Safety and security courses are provided annually. The first initial year is a scheduled course for classes. The following year there-after are four hour refresher courses. Random drills are initiated by the CSM, all security personnel act out each scenario.
Part II: Interview Summary:

During the interview I was not surprised by the security layout of the plant. I did however, learn a few things about my manager which may have taken for granted. I was not aware of how much work she did behind the scenes. I learned the concern she shares for the safety and well-being of the security of all employees. The appreciation which may go unnoticed for those who have a close work relationship with, while taking some responsibility off her plate sort to speak. The work delegated to the shift supervisor makes the work load manageable. The policies and procedures manual followed by all security personnel was written by the Director of Security, which is the way she wants the facility ran. Meaning, the manuals are of importance. Following the manual at the keeps the facility running the way it should be, which allows one to refer back to the manual as needed. Following procedures and policies is a form of backing when it comes to inter acting with the health care staff. For an example, the parking policy states any employee who fails to be compliant will be at risk to having their vehicle removed from the site, via contracted towing service, at their own expense. If one were to follow the policy exactly as it states, one is less likely to be at fault for an unauthorized tow. Such events have taken place at the facility of which Norma Dehlke; Director of Security and Human Resources has had to deal with. Due to the supervisor handling the situation as per the policy manual the employee has been left with the reality of the situation, which is she was warned on at least ten different occasions. Therefore, this led to her vehicle being towed at her expense. These serve as protection laws sort to speak, meaning this is a guide that demonstrates the length security personnel can take or knowing when to back away from a situation. Overall, policies and procedure manuals should be in place at any workplace. Employees should be able to refer back to the manual when in doubt of a situation. This can alleviate any misunderstandings in the work place. Security management relies on policies and procedures in the workplace for training measures.

Smackey Dog Foods, Inc - Scenario Summary


Smackey Dog Foods, Inc. started in the kitchen of Sarah, Kim, and Jillian?s family home in the suburbs of Chicago. The three sisters initially bought the ingredients for their natural dog food recipes from the local grocery store. They used their dogs and the neighborhood dogs as their taste testers. Their dog food products were so good, the local kennels and veterinary offices were glad to distribute the sisters' products to their customers.

Local demand increased significantly. Local pet stores and small grocery stores discovered the products and became distributors. The sisters moved the expanding business into a larger facility and hired a few more workers. While their competitors? sales were flat or declining, Smackey Dog Food, Inc.?s sales were on a vertical climb!

Sales were so good last year, that the sisters opened a boutique division named Best Boy Gourmet, specializing in freshly manufactured, one-serving packages meant for consumption no later than 3 days after production. They sell this product at 3 times the cost of their other products and by special order only through their new website. Demand is high, but waste has been an issue.

Sarah is the president and general manager of the operation. Sarah has been very proactive in growing the business. She has met with her banker to discuss expanding the facilities and equipment with another $150,000 loan. Their first loan for $150,000 was secured by the industrial size, food production equipment purchased with the loan. The banker now demands an audit of the corporate financial statements before releasing another loan to the company. Sarah has offered to place the corporate account receivables up as collateral to secure the second loan. Based on revenue projections by her sister Jillian?s sales team, Sarah believes that the company will not have trouble paying down the loan in a short period of time.

Kim manages the production operations. She oversees the inventory, production, and shipment of dog food products. The Best Boy Gourmet line has taken almost all of her attention lately. The winter holidays are approaching and sales demand based on forecasts from the sales force are higher than ever. Attaining fresh, raw ingredients is more difficult in the winter months. If any of the fresh ingredients are delayed, production comes to a standstill. There has been significant inventory waste as a result.

Kim?s assistant, Henry, monitors the production and shipment of Smackey Dog Food?s regular line of product. Henry takes pride in his work and is involved in every facet of the operation. With only one other warehouse employee to help, Henry personally is involved in preparing and approving all inventory records. Henry ensures that very little finished inventory sits in the warehouse. However, the shipping dock always seems to be full of returned dog food that should be restocked. When Kim asks him about it, Henry laughs and tells her that "first in first out" applies to dog food returns as well. Kim smiles and just accepts that answer.

Jillian is not very good at understanding accounting. The sisters placed Jillian in charge of sales. She manages a sales team of 12 salesmen in Illinois, Indiana, and Wisconsin. Her fear of flying and poor driving skills limit her ability to get around to the areas outside of Chicago. As a result, she has placed a lot of faith in her sales team. The sales team complained last year that they did not like waiting for their commissions until after bookkeeping calculated the actual revenues. In order to keep their spirits fired up, Jillian has her sales people project what their sales will be in the upcoming quarter and she pays commissions in advance on those projections. The sales team loves her and Jillian loves their approval. Jillian has noticed that the projections typically are off by 11% on average.

The employees of Smackey Dog Food, Inc. all own dogs. It was a hiring requirement on the job application. One employee was fired when it was discovered she never owned a dog when she was hired. A lawsuit is pending by the fired employee.

At this time, the receivables represent 29% of the corporate assets. The Chicago retail chain Pup Stores, Co. is Smackey Dog Food?s largest buyer. They alone represent 31% of overall sales and usually pay within 30 days. However, Pup Stores is facing a major lawsuit from an animal rights group. The legal fees are eating into their cash reserves and they are facing some store closures.

The accounts receivable aging indicates that 38% of the receivables are 30 days or less. Twenty-two percent are 31-60 days. Twenty-one percent of the receivables are 61-90 days old. Ten percent are 90-120 days. The remaining receivables are older than 120 days. Sarah has not written off any of the receivables, nor will she.

Sales are projected to steadily grow at 16% next year if the company does not expand its facilities. With the expansion, sales are projected, rising 26%, with the most significant jump in the last quarter after expansion is completed and holiday sales pick up.



Your Role

You and your firm, Keller CPAs, have never audited a dog food manufacturer. Although it is late in the year to be accepting a new calendar year-end audit, you need the work and have the time to devote to the audit before your 2-week ski vacation in February.

You begin the audit process just prior to year-end by sending your audit manager, Pete, and two audit staffers, Ben and Maureen, out to the client. They spend time assessing the client and planning the audit.

During the first month of field work after year end, Ben and Maureen note that the dog food bags piled high on the docks are marked ?Returned.? One employee is seen throwing bags of the premium Best Boy Gourmet dog food into the dumpster in the morning and pulling it out and throwing it into Henry?s car during the employee lunch hour.

Pete?s new best friend, Alan, was married to Smackey Dog Food, Inc.?s owner, Kim, 4 years ago. Alan is also good friends with the banker from whom Sarah is seeking the loan. Pete is unaware of the relationship. Pete has talked about some of the details of the audit to Alan over a few beers.

Learning by Doing
A nice aspect of a course in business communication is that you can learn by doing. In business communication, you can actually create real communications (such as emails, letters, memos, etc.) and see how they work out in real life. In the TUI tradition of creating Session Long Projects that actually apply to your life and work, we ask you to create a communication for the organization you are in.

Assignment:
Using the resources below, write one routine email and one goodwill email for the organization you are in. If you are not in an organization, you can pick one that interests you. (EDUCATION COUNSELOR OF THE AIR FORCE EDUCATION OFFICE) You can make up the content, or you can write real ones. After you've written them, analyze them, identifying all the principles for creating good news messages, routine messages and emails that it embodies. This should be three or more pages long.

Then write a brief summary (about 300 words) explaining why you wrote your message as you did. In this summary, please discuss your objectives and how you used the background readings.

Be sure to submit the e-mail and summary in the same document.
This section of the assignment should include references, properly cited, to articles from the background materials.

This assignment is a presentation
Scenario: Assume yourself as the Marketing & Sales Manager of ?ABCD Marketing Ltd? which has been operating in the UK for the last ten years. As part of your duties, you train newly appointed employees of the company. Due to rapid growth, the company has recently recruited a marketing executive and a good number of sales executives who need immediate training on certain aspects of sales planning & operations.
Today, you are delivering a presentation outlining certain aspects of sales planning & operations. All the new employees are attending and eager to listen to what you present.

NOT propose building a house, because investors typically already have financing before beginning such a project. When selecting your project, keep in mind the goal of CP-1 is to apply the techniques introduced during the course.
Focus on detailed cost estimating, scheduling, and project justification. Estimating includes specific assumptions made during the estimating process, as well as quantities, unit prices, hourly rates for tasks, and accumulated totals. Justification will include an NPV analysis of costs vs. projected detailed revenue streams over a five year period with cash inflows and outflows over the project life. Start-up and other costs, and revenue streams, should be derived from detailed project cost estimates and sales forecasts.
When you establish your financial data you must be reasonable. A product that is developed for a cost of $100,000 will rarely have a net income of $1,000,000 per year, but I have seen students dream that up in the past. The numbers should allow for the possibility of failure if things go wrong.
The CP-1 Project Proposal will be structured with the following sections:

Myra is an 83 years old woman. Myra has Alzheimer?s dementia and is in residential care. Her parents died a long time ago, and her husband, Sydney, died ten years ago. She has two children (Trevor and Jean) and eight grandchildren, although contact with them has steadily decreased as her condition deteriorated. Concerns were raised when Myra was found wandering a fair distance from her house in the early hours of the morning. She was unable to find her way home and was dressed only in her nightdress and slippers.
Myra had years previously worked as a veterinarian, her passion for animals evident in the range of pets (dogs, cats and budgerigars) that she and Sydney had kept at their house. After her retirement, Myra had been keen on outdoor pursuits and had with her husband been a member of a rambling club. She enjoyed meeting other people and had a very active social life. When not engaged in these activities she would content herself with word puzzles and crosswords as a way of ?keeping my mind sharp?.
Myra has fluctuating periods of lucidity and confusion, becoming extremely distressed when she is more aware of her deteriorating cognition (on one occasion she was found by healthcare staff screaming and shouting obscenities). She rarely gets involved with activities and poor concentration and confused thinking have made crosswords and word puzzles very difficult. Her mobility is poor and she has fallen on a number of occasions. She is also periodically incontinent (sometimes doubly), her poor orientation and levels of confusion causing problems. She rarely leaves the residential home and seldom has visits from her family, partly as they are often a distressing and confusing experience for all concerned.

My research paper is about the food industry's secrets that are kept from the public. This includes genetically altered foods and seeds, extreme animal cruelty on factory farms, employee neglect in factory farms, farmers' rights being ignored and neglected, diseases that are spread through force feeding animals including a new strain of E.coli, and our health and environment being damaged due to greenhouse gases and what they put in our food.

Here is my thesis so far:
The united states food industry is damaging our environment, our health, the farm animals, the livelihood of the American farmer, and worker's rights.

I have attached an outline that I have already done that shows what I would like to cover in the research paper. I also want to include how the food industry is damaging our economy as well, but I'm not sure how much information I can gather from that to make a solid paragraph or two. If you guys can find anything about how it damages the economy please include that as well.

3. Option Three: You are in the role of a chief operating officer for a for-profit insurance company. A board of directors has requested that you prepare a summary of the issues involved in a potential reduction in U. S. medical insurance reimbursement of 40%. Prepare a report for the board of directors on how to best meet the impacts of the proposed funding cuts while still being sensitive to the needs and health of the community and your patients. 4. Option Four: You are in the role of a chief administrative officer for a large nonprofit health relief organization. A board of directors has requested that you prepare a summary of the issues about how to solve the health needs of an African country. Your organization has limited funding and will need to obtain subsidized medicine from major pharmaceutical companies. They also have the opportunity to get non generic, non USDA approved, alternative stem cell derived medication from foreign sources. 5. Option Five: Your role is as a public official elected at the local city level; 50,000 to 250,000 population. You have a $10 million dollar budget allocated to you by the city manager and can get up to 100% matching federal funds if you meet the federal standards. You have been asked by the mayor to determine how to allocate the budget to best support the needs of the city. These could include but not be limited to supporting capital requirements, operational requirements, and subsidizing nonprofit organizations or used as economic incentives to bring new private concerns into the city. Treatment versus Punishment - That is the Question!

When looking at the relationship between social justice and juvenile justice, there are two over arching concepts when addressing juvenile delinquency - treatment and punishment. These two concepts have driven a cycle of changes in the juvenile justice system over the years. Your task is to support your premise that your state or city should either implement a philosophy of treatment or punishment for juvenile offenders for a specific crime or criminal justice issue identified in your paper.

Explain the differences between the treatment and punishment concepts. Build the case for which one you believe has the stronger position based on your research and the crime or criminal justice issue you selected to study.

REQUIRED QUESTION:

A. Ms. Riyadh is employed as an account executive with ABC Advertising (?ABC?). ABC is a national marketing and advertising firm specializing in domestic and international advertising. ABC has its corporate headquarters in this state and represents many major public and private corporations throughout the United States. Ms. Riyadh began working with ABC as a summer intern during her senior year in business school, and was hired as a full-time employee after receiving her M.B.A., with honors, from the University of Michigan in 1978. Ms. Riyadh has been employed with ABC at its office in the state capital since 1978. During her employment, she has won three national awards for her work.

For several reasons, Ms. Riyadh believes ABC has illegally discriminated against her and she now wants to sue the company. She says the company's practice has been to promote employees from within. Ms. Riyadh states that despite receiving "outstanding" performance evaluation ratings each year she has worked there, she has never been promoted since she was hired and has been repeatedly passed over for any promotions.

She also says that all of the male employees who were hired between 1978 and 1988 in the same classification as hers have been promoted from one to four times and earn significantly higher salaries. In addition, none of these employees has won any national awards, and a few of these individuals are marginal employees. She notes that three women have been promoted since she was hired, but points out that men greatly outnumber women in all positions at ABC.

ABC responded to a preliminary inquiry by asserting that Ms. Riyadh was not promoted because she doesn't "fit the image" that is right for the higher positions. ABC claims the higher positions have high visibility, require extensive travel, and have greatly increased client contact, including presentations before corporate and professional groups. ABC argues that Ms. Riyadh is a very plain woman, that she refuses to wear make up or adornments of any kind, other than a head scarf, that she is very religious and takes a daily "prayer and meditation" break during her lunch break, and that her religious beliefs prohibit certain types of "fraternizing," such as drinking alcoholic beverages and eating certain foods. ABC officials state that while Ms. Riyadh is a good employee, they do not believe she is "qualified" to represent ABC in certain capacities. ABC argues that in the advertising field, it is essential that higher "administrative" employees project a polished appearance and engage in social and fraternal activities in order to obtain and conduct business.

Ms. Riyadh states that ABC is discriminating against her. She argues that these factors are not relevant to her ability to perform in any of the higher positions, and that ABC is simply using other rationales as a ploy to justify discriminating against her. She further states that when ABC hired her, she was advised that if she did a good job, she could expect to be promoted to the position of account vice-president within two years.

Ms. Riyadh seeks damages for lost wages and benefits. She also wants a court order directing ABC to promote her to a higher position. Analyze Ms. Riyadh?s case. Identify all potential claims and any defenses available to ABC.

1. Unified Postal Services (UPS) is a private corporation which provides mail services to the public. UPS has been sued by a class made up of all deaf employees. These employees claim to have been discriminated against based on their disability. UPS provided training to all employees on security and safety in handling mail, including packages. The training included several videos on Anthrax, after several workers were injured by packages containing the lethal substance. The deaf workers claim that UPS never provided interpreters or videos with subtitles. UPS claimed that it did not have to provide accommodation to the workers because they were able to view the videos and watch the demonstrations on handling packages. The company claims that the workers are not disabled for the purposes of handling packages. Will the employees win the case?


2. Bob Smith, a member of the electrical workers' union employed at Saturn Company, had a history of tardiness and absenteeism. One morning, he had car problems which delayed his arrival at work. When he finally arrived at work, Bob was told that he was fired. The union filed a grievance on Bob's behalf, objecting to the discharge. In accordance with the collective bargaining agreement, an arbitration hearing was held. The arbitrator, after weighing testimony and evidence, ordered Bob reinstated with back pay. The arbitrator found that Saturn had not properly and objectively investigated Bob's car problems and therefore did not have just cause to fire him. Saturn refused to reinstate Bob in compliance with the arbitrator's award. Bob and the union petitioned the U.S. District Court to enforce the arbitrator's award. Saturn petitioned the court to overturn the arbitrator's decision, claiming that, based on the evidence, the dismissal was unquestionably for just cause under the labor agreement. Should the court grant Saturn's request and overrule the arbitrator? Explain your answer.

3. Martha has applied for a job as a stock clerk, at Good Food Supermarket. During her interview, she reveals to the interviewer that at some point in the next ten months she will need to undergo surgery to remove a tumor in one of her vertebrae, and that even if the surgery is successful, her post-operative range of movement could be severely limited. The job requires a good deal of lifting and a wide range of movement, in order to place goods on the shelves. The interviewer decides not to hire Martha because she may not be able to perform the job after the surgery. Martha files a claim against Good Food Supermarket. Does she have a valid claim? Explain your answer.

4. Muhammad, an Arab-American high school student, had a job after school in a fast-food restaurant, Eddy?s BBQ. A few co-workers started asking him why his ?cousins? bombed the World Trade Center. Muhammed ignored their taunts. Then a manager began to add comments such as, ?Hey, Muhammed, we?re going to have to check you for bombs.? Muhammed felt humiliated and angry. Soon after, he was terminated for accidentally throwing away a paper cup that the manager was using. Muhammed suspects that his religious and ethnic background was the reason he was fired. Muhammed has filed a claim with the EEOC. What will be the result in this case?

5. Patsy is a waitress at Tom?s Irish Pub. She complains to her boss, Tom, that Simon, a frequent patron of the restaurant, has been making comments to her with sexual innuendos. Patsy details Simon?s activities to Tom, and requests that Simon be asked to stop. She also requests that another waitress be assigned to Simon?s table. Tom, the restaurant owner, says he will look into the matter. Tom is afraid to upset Simon, who is one of the restaurant?s best customers. Tom puts the matter off for a few weeks. When he finally gets around to dealing with Simon, he politely asks Simon if he can ??go a little easier on Patsy.? Tom ignores Patsy?s request to be relieved of any obligation to wait on Simon. Does Patsy have a claim against Tom?s Irish Pub? Explain your answer.

6. Paul Jones was an operations manager at the Wallsbury Company. His employment status was that of an employee at will. Jones received certain email messages at home, and he replied to his supervisor by email. His email messages contained some provocative language, including a reference to "kill the backstabbing jerks" and a reference to the "Jim Jones Koolaid affair". Later Jones was given 2 weeks notice of his termination and he was told that his email remarks were inappropriate and unprofessional. Jones believes he is a victim of invasion of privacy because the email messages caused his termination and the company had promised that email communication would not be intercepted and used as a basis for discipline or discharge. The company denies that it intercepted the email messages and points out that Jones himself send the unprofessional comments to his supervisor. Who should win the case ? Jones or Wallsbury Company? Why?

7. Dr. C. Brown, was an employee of Mars Pharmaceutical Products Inc. and was severely injured and hospitalized when a vat used in the production of AAXXN, an anesthetic ingredient, overflowed, spraying toxic chemicals into the immediate area. Brown, an employee with 20 years experience was tending the vat at the time of the overflow. OSHA inspector James Johnson was dispatched to investigate the incident. Johnson spoke with some employees who helped wash down Brown. A fellow employee who saw Brown after the accident told Johnson that Brown was "covered from head to toe with chemical, including his head and mouth." Brown's supervisor told Johnson that it was "company policy" that the vat operator wear a respirator, chemical goggles, and gloves. Although no one testified as to exactly what type of protective gear that Brown was wearing, the OSHRC found Mars in violation of a specific regulation that compels an employer to make sure that an employee engaged in an operation like Brown's is wearing full-body protective gear, including boots, chemical retardant clothes, a full face shield and a self-contained breathing apparatus.

Mars appealed this decision to the court of appeals, claiming that there was not enough evidence to support a citation for a violation of the chemical clothing requirements as no one testified exactly as to what Brown was wearing. What factors should the court consider when deciding whether to enforce or vacate an OSHRC decision? Should the court set aside this OSHRC decision? Why or why not?

8. Sam has been turned down for a job as an ambulance driver because he is age 65. The rationale is that most individuals his age have certain health related characteristics that legitimately exclude them from effective service as ambulance drivers. Sam was never individually evaluated to determine whether he possessed the disqualifying characteristics. Does Sam have a claim against the hiring company? Explain why or why not.

9. A video camera aimed at the factory floor where U.S. Postage stamps are printed records what appears to be Murray, a line employee, stealing sheets of stamps from the production line. Based on the tape, factory officials search Murray's locker and find the stolen stamps. Murray challenges the search as unconstitutional. Is the search legal? Why or why not?

10. Bob Cash is the manager of People First Bank ("People First"). One day, Bob received a call from one of the bank's largest customers ? Million Dollar Construction ("Million Dollar"). The CEO at Million Dollar asked Bob to send an account representative from the bank to discuss some new loans for Million Dollar. This is a very important customer and Bob wants to make sure he does everything to satisfy their business needs. Bob sends his top-performing account representative, Joe, to meet with the CEO. Shortly thereafter, Bob receives an angry phone call from the CEO, who claims he does not do business with anyone who is not Caucasian, and Bob should not have sent Joe, who is African-American, to meet with him.
